中文摘要 | 家長教育權是一種自然的權利,而家長教育選擇權在這一波國內教育改革運動中 ,已開始受到重視。作為一個擁有教育權主體的兒童與家長,在教育改革的權利重分配過程 中,理應透過選擇權的行使,以滿足其教育需求。本文的目的在探討家長教育選擇權的理論 基礎、美國對家長教育選擇權的實施情形、及國內在國民教育階段家長教育選擇權的可行性 ,俾提供教育決策及進一步研究的參考。家長教育選擇權,無論由哲學、經濟學、社會學、 法學及行政學的觀點,均可獲得支持性的看法。家長教育選擇權運動在美國已正式推動近二 十年,在理念上雖然仍有爭論,實施成效上仍有賴進一步的研究,但在其強調公平、效率及 追求卓越的潮流中,家長教育選擇權運動仍會持續在各州推行。臺灣的教育具有本土的文化 背景,家長教育選擇權的行使必須植基在現有架構上加以探討,才能有較實際的作為。而教 育選擇無論是入學前的選擇 (公私立學校的選擇、公立學校間的選擇、公立學校內的選擇、 教育券的實施 )、教育過程的選擇 (課程的選擇、 教育的選擇、教師的選擇 ) 及進路的選 擇 (高中職與五專聯招的選擇、高職免試入學的選擇 ),均應重視基於學生最佳利益保障下 的選擇機會。惟在推動過程中,仍應重視潛在的問題。 |
英文摘要 | The educational rights of parents are the natural rights, and the educational choice of parents have been emphasized recently on the movement of educational reforms in Taiwan. Parents and children who have the educational sovereignty position shall have the rights to make choices to satisfy their needs of education when the rights of education are reallocated under the process of reforms. The purposes of this article are to examine the rationales of the educational choice of parents, and to analyze the movement of the educational choices in America, and to explain the applications on the compulsory education in Taiwan. There are some supportive rationales of the educational choice of parents on the philosophy, economics, sociology, law, and the administrational theories. The movement of the educational choice have been implemented for about two decades in America. Although there are some issues, the movement will still be pushed in each state under the stream of the equity, efficienty, and excellence. Based on our context, the educational choice of parents can be examined on the choice of school before entrance, including the choice of public or private schools, inter-public schools, intra-public schools, and the implement of vouchers; on the processes of education, including the choice of curriculum, materials, and teachers; on the choice of trace after junior high school, including the choice of the joint examination of entrance and the free entrance of the vocational high schools. All of the choice must be considered carefully on the benefits of the children and prevented the latent problems. |
